Attachment to the Pakorent Dawid Pokój Vehicle Rental Agreement

§ 1. INTEGRATION & LANGUAGE

1. These GTC form an integral part of the "Rental Agreement" (Page 1) and "Handover Protocol" (Page 2) generated by the reservation system. 2. Tenant details, Vehicle parameters, rental rates, deposit, and technical condition specified on Pages 1 and 2 are binding and prevailing. 3. Language Declaration: The Tenant declares that they speak Polish or English to an extent that allows for a full understanding of the Agreement. If the Tenant does not speak these languages, they confirm having translated the content on their own before signing. 4. Electronic Form: The Agreement is concluded in documentary form. The signature placed by the Tenant on the tablet (mobile device) is legally binding. The finalized document (Agreement + GTC) is automatically sent to the Tenant's email address, which the Parties recognize as effective delivery of the Agreement copy.

§ 2. PAYMENTS & DEBT RECOVERY

1. Authorization (Card-on-File): The Tenant irrevocably authorizes the Lessor to charge the credit/debit card indicated in the system with all dues arising from the Agreement, also after the vehicle return (rent, extensions, fuel, damages, fines, administrative fees). 2. Debt Recovery Costs: In case of payment failure, the Lessor implements a monitoring procedure. The Tenant agrees to cover lump-sum administrative costs: • Stage I (7 days overdue): Pre-court Payment Notice (SMS/E-mail) – fee: 150 PLN. • Stage II (14 days overdue): Final Notice and entry into Debt Registers (BIG/KRD) – fee: 250 PLN. • Stage III (21 days overdue): Transfer to external Debt Collection/Court – case file preparation fee: 300 PLN. 3. These fees are independent of statutory interest and court costs.

§ 3. USAGE RULES

1. Driver: The Vehicle may only be driven by the Tenant or a person named in the Agreement (driving license min. 2 years). Sharing the car with third parties is prohibited under penalty. 2. Prohibitions: Strict ban on: smoking tobacco/e-cigarettes, transporting animals (without consent), towing, racing, and driving under the influence of alcohol/drugs. 3. Speed Limit & GPS: A speed limit of 160 km/h applies. The vehicle is monitored (GPS). Exceeding the limit results in a contractual penalty for each violation. 4. Abroad: Traveling outside Poland requires written consent. Leaving without consent (especially non-EU) results in immediate termination of the contract and high penalties.

§ 4. RETURN & FUEL

1. Time: Return delay >1h without consent results in a charge for another day + penalty. 2. Fuel: Return with the same fuel level as at pick-up. • Missing fuel = Cost of fuel + Service fee. • Excess fuel = No refund. 3. Cleaning: The vehicle must be clean. For excessive dirt, a washing/cleaning fee will be charged.

§ 5. INSURANCE, LIABILITY & DAMAGE

1. Excess: If protection offered directly by the Lessor is purchased, the Tenant is liable for damages up to the Excess amount specified on Page 1 of the Agreement. 2. No Lessor Protection (Full Liability): If the rental rate does not include insurance offered by the Lessor, or if the Tenant uses external insurance (e.g., broker policy, credit card, travel insurance): • The Tenant bears full financial responsibility for all damages, theft, and loss of vehicle value up to 100% of their amount. • The Lessor is not a party to claims against the external insurer. The Tenant is obliged to cover damages directly to the Lessor upon vehicle return (or be charged from the card) and then claim reimbursement from their insurer on their own. 3. Protection Exclusions (SCDW/CDW): Regardless of the insurance purchased, the Tenant covers 100% of the damage in cases of: • Intentional act, gross negligence, fleeing the scene, or lack of a Police report from the collision scene. • Driving under influence (alcohol/drugs) or without a license. • Damage to: interior, tires, rims, glass, undercarriage, roof, and lost keys/documents. • Refueling with wrong fuel. 4. Missing Items: In case of loss or damage to equipment not explicitly listed in the Fee Table (e.g., trunk cover, car jack, bodywork parts) the Tenant will be charged an Administrative Fee (300 PLN) plus the market cost of purchasing a new part according to the authorized service price list.

§ 6. TABLE OF FEES AND CONTRACTUAL PENALTIES

The table below constitutes a schedule of lump-sum administrative fees and contractual penalties for breaching the Agreement terms. All amounts are gross (PLN). *** Calculation principle for price ranges: In case of items defined by a price range, the final amount consists of: the market purchase price of a new item (according to the authorized service ASO price list) plus an administrative fee (installation/logistics) of 150 PLN. 1. FUEL & CLEANING: • Smoking tobacco or e-cigarettes: 600 PLN • Dirty vehicle return (Standard): 300 PLN • Deep cleaning (stains, pets): 600 PLN • Unauthorized animals: 200 – 650 PLN • Baby seat cleaning: 50 – 200 PLN • Wrong fuel: 1000 PLN + Repair • Missing fuel: Fuel cost + 50 PLN Service 2. DOCUMENTS & KEYS: • Lost key or remote: 5000 PLN • Lost documents or policy: 1500 PLN • Lost plates (2 pcs): 2500 PLN • Lost plate (1 pc): 1500 PLN • Lost parking ticket: 200 PLN 3. MISSING EQUIPMENT: • Lost GPS Device: 600 PLN • Child seat: 1000 PLN • Booster seat: 200 PLN • Spare wheel: 1500 PLN • Repair kit: 600 PLN • Trunk shelf: 800 PLN • Fire extinguisher: 300 PLN • Floor mat (piece): 250 PLN • Wiper blade: 250 PLN 4. USAGE PENALTIES: • Speeding >160 km/h: 1500 PLN • Unauthorized exit (EU): 1500 PLN • Unauthorized exit (Non-EU): 20 000 PLN • Unauthorized driver: 1000 PLN • Driver <25yo (undeclared): 1500 PLN • Warranty loss due to Tenant fault: 15 000 PLN 5. ADMINISTRATIVE: • Data transfer to Police (Poland): 150 PLN • Data transfer to Police (outside Poland): 200 PLN • Paying fine on behalf of Tenant: Fine amount + 200 PLN • Failure to report damage: 2500 PLN • Unauthorized extension: 300 PLN + 200% rate • Payment Call (Debt Recovery): 150 – 300 PLN (per §2) • Reservation Reinstatement (No-Show): 150 – 1000 PLN

§ 7. FINAL PROVISIONS

1. Matters not covered shall be governed by Polish law (Civil Code). The competent court is the court of the Lessor's registered office. 2. Prevailing Language: The Agreement is bilingual. In case of discrepancies, the Polish version shall prevail. 3. Data controller is Pakorent Dawid Pokój (details: www.pakorent.pl/privacy).
